Know Your Obligations

Employer & Worker Responsibilities

Under Australian Workers' Compensation legislation, both employers and workers have legal obligations when a workplace injury occurs. BizPort ensures both parties are guided through every requirement.

Employer Obligations

Under Workers' Compensation legislation
  • Report the injury to your Workers' Compensation insurer within the required statutory timeframe (typically 48 hours of being notified).

  • Appoint an accredited RTW Coordinator (mandatory for employers above the prescribed wage threshold in most states).

  • Develop a written RTW Plan in consultation with the worker and their treating practitioner within required timeframes.

  • Provide suitable duties where reasonably practicable — consistent with the worker's medical capacity and work restrictions.

  • Maintain employment of the injured worker for the prescribed period and ensure no adverse action is taken in relation to the injury.

  • Cooperate with the insurer, treating practitioners, and the RTW Coordinator throughout the recovery and claims process.

Worker Obligations

Under Workers' Compensation legislation
  • Notify the employer of the injury as soon as practicable and provide a medical certificate from a treating practitioner if required.

  • Participate actively in the development of the RTW Plan and engage constructively with the RTW Coordinator and treating practitioners.

  • Undertake suitable duties offered by the employer that are within their medical capacity, unless their treating practitioner certifies otherwise.

  • Attend medical appointments and treatment sessions as directed by treating practitioners and required by the insurer.

  • Provide updates on their medical condition and recovery progress to the employer and insurer as required under the claims process.

  • Take reasonable steps to ensure their own recovery and cooperate with any rehabilitation or retraining programs arranged in support of their RTW.
